Procedure
Importers of dangerous chemicals must identify the hazards, provide information about them under the Classification, Labelling and Packaging of chemical substances and mixtures (CLP) regulations and ensure they package the product safely before importing them into Kenya.

These guidelines are intended for person(s), companies and other stake holders involved in any act of importation of Restricted chemicals into Kenya.

Step 1
Submit an Application letter.
A written application should be sent to the Registrar of Pharmacy and Poisons Board in Kenya, this Letter must be on the letter head of the company which has a telephone number,Chemical registration Number,and e-mail account to import industrial, consumable, laboratory, agricultural and restricted chemicals controlled under international conventions.

Step 2 documentation.
The foreign exporter who wish to import restricted chemicals shall prepare the following materials and submit those documents to the Registrar of Pharmacy and Poisons Board in Kenya,
Then attach the following documents before submission,

A copy of certificate incorporation (original for sighting)
A Certified true Copy for memorandum and articles of association
One Certified true Copy of particulars of the directors, Form CO7 (original for sighting)
Copy of Current Tax Clearance (original for sighting)
Permit from Ministry of Agriculture of solid minerals
A letter of Authority from power holding corporation of Kenya
Proforma invoice for permit to import restricted chemicals.
Evidence of PPB listing certificate of Marketers of the chemical.
Certificate of Manufacturing issued by relevant regulatory Authority.

Step 3
Pharmacy and Poisons Board in Kenya will conduct completeness and correctness check within 15 days from the receipt of all documents and application fee. A reference number will be allocated for each application and preliminary feedback will be given to the applicant through the contact address provided on the application form. Therefore it is important to provide an email account and the current telephone contact on the application form.

Step 4
Import Permit to clear :
Provides information which broadly outlines what goods are prohibited or restricted, where you can obtain more information about the control and, in the case of restricted goods, the mailing address or e-mail address to use to apply for permission to Import. If the documents complied with the PPB requirements, permit to import samples of products is issued to the applicant. The applicant is required to import specified samples to be used for vetting and Lab analysis.

Step 5
Labeling on the chemical:
provide general information about the imported restricted chemical and this will include labeling the imported product. The labeling on the chemical must be in accordance with the global harmonizing system of classification and labeling chemical.

The labeling should include the name of the product
Name and address of the manufacturer/importer
Batch Number
Production and expiry date
Storage condition
Net weight/Volume.

Step 6
Inspection:

Once the products are labelled the the inspection exercise is conducted to ensure that the storage facility are in conformity with the standard measures and practice. The Routine inspection is done by PPB to ascertain compliance.Find out from Customs if the goods you're importing are prohibited or restricted imports on inspection.

Step 7
At this stage, if the product have gone through the various stages and the (PPB) Registrar of Pharmacy and Poisons Board are satisfied with the documentation then the permit is issued first on yearly basis and later on renew more years can be extended.The applicant must note that the issuance of the permit to import restricted chemicals does not authorize the importer to clear the consignment with out fist obtaining the clearing permit from the import control Division in Kenya.

Pharmacy and Poisons Board in Kenya will review each application and provide the results from their basic

Eligibility
All Individual or companies interested in importing restricted chemical products and other related products into Kenya.

Instructions
The Registrar of Pharmacy and Poisons Board is the bodies in Kenya that the statutory responsibility of regulating and controlling the manufacture, importation, Distribution, sale and use of Restricted chemicals, (called regulated products).

According to The Registrar of Pharmacy and Poisons Board the following are cosidered to be prohibited good in Kenya and other member states.

All goods prohibited under the Customs Management Act, or by any written law in force in any of the Partner States.
False money and counterfeit currency notes, coins and any money not being of the established standard in weight or fineness.
Pornographic materials in all kinds of media, indecent or obscene printed paintings, books, cards, lithographs or other engravings, and any other indecent or obscene articles.
Matches containing white phosphorous.
Any article made without proper authority with the Armorial Ensigns or Court of Arms of a Partner State or having such Ensigns or Arms so closely resembling them.
Distilled beverages containing essential oils or chemical products, which are injurious to health, including thijone, star arise, benzoic aldehyde, salicylic esters, hyssop and absinthe. Provided that nothing in this paragraph contained shall apply to "Anise and Anisette" liquors containing not more than 0.1 per centum of oil of anise and distillates from either pimpinella anisum or the star arise allicium verum.
Narcotic drugs under international control.
Hazardous wastes and their disposal as provided for under the base conventions.
Soaps and cosmetic products containing mercury.
Used tyres for light Commercial and passenger vehicles. A clarification is required.
Counterfeit goods of all kinds.
All goods the exportation of which is regulated under the EAC Customs Management Act or by any law for the time being in force in the Partner States;

(a) waste and scrap of ferrous cast iron;
(b) timber from any wood grown in the Partner States;
(c) fresh unprocessed fish (Nile Perch and Tilapia);
(d) wood charcoal.

Required Information
The Kenyan Government controls the import of certain goods into Kenya and the key information required is as follows:

The materials safety data sheet (MSDS)from the manufacturer Which should have the following information:

Identification of the product and company (owner or the person in charge)
Composition and information on ingredients including
Information on Hazard identification.
Information on First aid Measures.
Information on fire fighting measures
information on accident release measures.
information on handling and storage.
information on exposure control/ personal protection measures.
information on physical and chemical properties
information on stability and reactivity.
Toxicological information
Ecological information
Information on disposal consideration
Transport information
Regulatory information and others information.

Need for the Document
Kenya has very stringent plant introduction and certification procedures that are set to ensure that foreign injurious pests, disease and noxious weeds are not brought into the country. This procedure is for guidelines for person(s)companies and other stakeholders involved in any act of importation of restricted Chemicals into Kenya. These importation include industrial goods,consumable,laboratory,Agriculture and restricted chemical controlled under international convention.

The Kenyan Government controls the import of certain goods into Kenya. The controls include:

An absolute prohibition, where you are not allowed to import the goods in any circumstances, or
A restriction, where you need to have written permission in order to import the goods.
If youre planning to export certain pesticides or hazardous chemicals outside of the kenya you may need to go through a notification procedure and, in some cases, obtain prior informed consent (PIC) from the importing country before the export can take place. This procedure is overseen by the Health & Safety Executive (HSE), which makes sure that: Certain essential but inherently hazardous chemical products may be declared by the Government Code Regulations to be restricted chemical products (RCPs). These products are strictly controlled by the government.

Restricted Chemical Products can only be supplied to persons who are authorized to use the product under the laws of a state Kenya.

Chemicals are exported at least six months before their expiry date
Exports of chemicals that have a severely restricted use within the East Africa have complied with a mandatory notification procedure.
no chemicals are exported that are banned within the East Africa community. exports to countries outside the East Africa are packaged and labelled in line with the United Nations Open General Licence Globally Harmonized System. The relevant Kenyan state or territory authority determines who may be considered as an authorized person, based on advice from the The Registrar of Pharmacy and Poisons Board (RPPB) following a risk assessment of the chemical productthese are people with specific training or qualifications in the safe handling and use of Restricted Chemical Products in Kenya.

This procedure is for guidelines for person(s)companies and other stakeholders involved in any act of importation of restricted Chemicals into Kenya. These importation include industrial goods,consumable,laboratory,Agriculture and restricted chemical controlled under international convention.

An Applicant wishing to obtain a permit to clear Chemical restricted and controlled under international convention in Kenya should follow the following procedures and guideline as discussed below.
