Procedure
Applicants can apply any time within the financial year for consideration and licensing.

Fill the Application for a Management Agent Certificate Form http://www.coffeeboardkenya.co.ke/index.php/component/phocadownload/category/13-coffee-management-agent-s-certificate?download=28:application-for-a-management-agent-licence-form and attach all the required documents.
When filling the application form, make sure the information is correct and also indicate whether it is an application for a new license or renewal of a license.

Before submitting your application, make sure you have fulfilled all the requirements set by the Coffee Board of Kenya.

All new licenses shall take a maximum of 90 days to process in line with the service charter of the Board.

All License renewals are subject to compliance with the terms and conditions and are issued upon payment of the respective license fees.

License application forms are downloadable from the Boards website and fees payable during submission of application forms.

All enquiries should be directed to the Managing Director Coffee Board of Kenya.

Required Documents
A certified copy of certificate of incorporation/or registration.
A certified copy of memorandum and articles of association.
A statement listing the names of holding companies, associated companies or partnership, in which the applicant has interest (if any).
Names and addresses of two business referees.
Demonstrate capacity to offer prescribed services.

Instructions
According to the Coffee Act a person is not allowed to deal in or transact any business in coffee unless he is the holder of a current license thereto authorizing him, issued, in its discretion, by the Board.

Need for the Document
A Management Agents certificate is issued to firms interested in rendering management services (professional services) in respect of coffee farms or pulping stations. The Management Agency certificate is registered under the coffee (Forms) Rules, 2002 of Legal Notice No. 124.

Coffee board of Kenya is the industry regulator of the Kenyan Coffee industry. Among its functions is to carry out licensing of coffee nurseries, growers, pulping stations, millers, marketing agents, management agents, buyers, roasters, packers, warehousemen and auctioneers to ensure adherence to standards.

To this endeavour the board has put in place measures and procedures for applicants to follow for one to be licensed as an industry player.


Terms and conditions

A registered management agent shall not unreasonably withhold a no objection letter sought by a prospective management agent.
A grower wishing to terminate management agreement with a current management agent shall give six months notice of intention of termination.
A management agent wishing to terminate the management agreement with a grower shall give notice of six months of intention of termination.
A grower wishing to terminate management agreement with management agent shall give notice of six months to the Board.
A management agent wishing to terminate management agreement with a grower shall give notice of six months of intention of termination.
All management agreements shall be registered with the Board within thirty days after the commencement of the agreement by the Management Agent.
The Board may sanction any amendment of the management agreement recommended by either party in the interest of the coffee grower.
The management agent shall exercise due prudence and diligence in executing the provisions of the specific management between him and the grower.

The Coffee Board of Kenya is the apex body for the coffee industry, established in 1934 after the enactment of the coffee industry ordinance in 1933. The Board was charged with the responsibility to carry out regulation and marketing of coffee. The auctions as a mode of selling Kenya coffee was established in 1934 and created in 1935 to enhance quality assessment through the grading. This role has changed over time through various amendments to the law. In 2001, the coffee Act cap 333 was repeated and the coffee Act No. 9 of 2001 enacted, establishing the Board as a statutory body under the Ministry of Agriculture, solely to regulate the coffee industry.

The object and purpose for which the Board is established is to promote competition in the coffee industry, production, processing and value addition including branding of Kenya coffee locally and internationally, and generally to regulate the coffee industry in the public interest. The following general objectives form the basis for the Boards activities:

To formulate policies and rules to regulate and develop the coffee industry in the consultation with the Ministry of Agriculture.
To carry out registration and licensing of coffee nurseries, growers, pulping stations, millers, marketing agents, management agents, buyers, roasters, packers, warehousemen and auctioneers to ensure adherence to standards.
Provide advisory services related to coffee production and quality enhancement.
Collect, collate, analyze data, maintain a database on the coffee industry and document and monitor it through registration of persons dealing with coffee.
Advise and guide Coffee Research Foundation in the carrying out of research in all matters related to the coffee industry.
Representing the Government in international for a in regards to coffee matters.
Arbitrate in case of any disputes in the industry.
Carry out other functions aimed at the promotion of the industry.
