Licenses are issued by the National Environmental Management Authority (NEMA).
Regulations are currently being enforced by the County Governments of Kenya.
NEMA offices are located at the Environmental Department of County Governments.
Apply in Person
Visit the NEMA offices in the environmental department of the County Council Offices to make the application.
Here the environmental officer will briefly interview you to determine the nature of your application and issue you with an application form (APPLICATION FOR A LICENSE TO EMIT NOISE/ VIBRATIONS IN EXCESS OF PERMISSIBLE LEVELS) to fill and complete.
Provide accurate information for the information you give will be verified.
You are to attach the following documents with to your application form for submission.
(i) Police permit allowing the event which will result to the emission of noise/ excess vibration to take place
(ii)Letter of consent form at least 10 neighbors
Proceed to pay the prescribed application and licensing fees and submit the payment receipt together with the application form. The fees are as follows
Application for a license Kshs. 200
License fees Kshs.2,000
Your application will then be processed. Processing involves the NEMA officers visiting the proposed site for the event to determine the accuracy of the information given.
After processing the license is usually ready for collection at NEMA offices after 2 days.

Any person with intention to make or cause to be made any loud, unreasonable, unnecessary or unusual noise which annoys, disturbs, injures or endangers the comfort, repose, health or safety of others and the environment.

Need for the Document
The license is issued by the National Environment Management Authority in order to control noise and excessive vibration pollution for protection of human health and environment.
Noise regulations aim at ensuring the maintenance of a healthy environment for all people in Kenya; the tranquility of their surroundings and their psychological wellbeing by regulating noise levels and excessive vibration.

No person in Kenya is to make or cause to be made any loud, unreasonable, unnecessary or unusual noise which annoys, disturbs,injures or endangers the comfort, repose, health or safety of others and the environment
No person in Kenya is to make or cause to be made excessive vibrations which annoy, disturb, injure or endanger the comfort, repose, health or safety of others and the environment
Any person in charge of a party or other social event which occurs on any private or public property shall ensure that the party or event does not produce noise in a loud, annoying or offensive manner such that noise from the party interferes with the comfort, repose, health or safety of members of the public within any building or, outside of a building, or recklessly creates the risk thereof, at a distance of 30 meters or more from the source of such sound.
No person shall use any sound-amplifying equipment in such a way that such equipment is or is likely to be heard outside of any building between 9:00 p.m. of any day and 7:30 a.m. of the next day, without a valid license.
Where any person uses or plans to use a public-address system which is likely to emit sound outside of a building, such person shall secure a license

In determining whether noise is loud, unreasonable, unnecessary or unusual, the following factors may be considered-
(a) time of the day;
(b) proximity to residential area;
(c) whether the noise is recurrent, intermittent or constant;
(d) the level and intensity of the noise;
(e) whether the noise has been enhanced in level or range by any type of electronic or mechanical means; and,
(f) whether the noise can be controlled without much effort or expense to the person making the noise
