Procedure
Step 1

The first step to register a political party is to form a Political Association of members then you can send in your application by seeking registration as a political party (hereinafter referred to as "an association") and addressed it to the Chairman of the Electoral-Commission and submitted to the Commission's Headquarters not later than 4.p.m. on the 180th day preceding the commencement of the next general elections (states and parliamentary elections).

Step 2
The Second Step is to fill the application for registration as a political party on commission's Form A in 20 copies and attach the the following documents:

(a) The name of the proposed party;
(b) The names, signatures and residential address of the chairman and secretary of the association filing the application;
(c) Evidence of payment of the prescribed fee of Ksh.10,000 (one hundred thousand naira).
(d)Twenty copies of the association's constitution and manifesto.
An application for registration of a political party must also include (Political Parties Act 2007, 18):

(a)the name of the party and, if desired, its abbreviation;
(b)a copy of its constitution
(c)the prescribed fee; and
(d)a request for the registration of the emblem of the party to be used on ballot papers.
Note
No Association by whatever name called shall be registered as a political party unless the association submits to the chairman of the commission in person not later than 4p.m on the 150th day preceding the next general elections with the following documents:

(a)The names, signatures, residential addresses and
(b) Districts the local council areas of origin respectively of members of its national and state executive committees and the records of proceedings of the meeting where these officers were elected.
(C) The name or acronym of the association must:
(i) not be the same as the name or acronym of an existing party or any organization;
(ii) not have any ethnic, religious, professional or other sectional connotation;
(iii)not give the appearance that its activities are confined to a part only of Kenya;
(iv) not be couched in such a way as to be capable of misleading the voters.
(v) A register showing that its membership is open to every citizen of Kenya (who is a registered voter) irrespective of place of origin, circumstances of birth, ethnic group, sex or religion.
Step 3
You should attach a copy of the association's constitution which must be registered in the commission's Form A and shall contain among other things:

1. the association's aims and objectives, name symbol, emblem and motto;
2. provisions for periodic election or democratic basis of the principal officers and members of the executive committees or other governing bodies.
Step 4.
You should give a provision that the members or other governing bodies and administrative personnel at the national level reflect the state character principle of the Constitution of the Republic of Kenya;

Step 5.
Give a provision showing that the association constitution and manifesto conform with the provisions of the Constitution, the Electoral Act and Political Parties Act 2007, 19(2),(4)) and these guidelines;

(a). a provision relating to disciplinary procedure of the association stating clearly the method of expelling an ordinary member, party official, political office holder including persons elected into public office on the platform of the association;
(b). a provision relating to the method of amendment or alteration of the constitution and
(c). a provision stating that the national headquarters of the association is situate in the Capital City in Nairobi.
(d). Names, signatures, thumbprints, dates of joining, residential addresses of registered voters in at least various Districts of Kenyan and FCT who are members of the association and do not belong to any other political party or any other political association.
(e). An affidavit sworn to by the chairman or secretary of the association to the effect that no member of the association is a member of any other existing party or political association.
(f). A bank statement indicating the bank account into which all income of the proposed political association has been paid and shall continue to be paid and from which all expenses are paid and shall be paid.
(g). Give the address of its headquarters in Nairobi and the addresses of its offices, list of its staff, list of its operational equipment and furniture in various districts of Kenya.
Step 6.
Give Evidence of ownership or rental of such office.This can be attachment of Land Title or receipts of payment for the rent.

Note
The symbol of the association must not portray any of the following:

Coat of Arms of the State;
Coat of Arms of any other country;
Any device or emblem which is normally associated with any of the following:
Any official acts of government or armed forces of the federation or Nigeria Police force or other uniformed service; or
Any tribe or ethnic group; or
Any religion or cult.
Any portrait of a person living or dead
Any symbol or part of a symbol which has been registered by another political party in Kenya or political association or any public organization.
After the last date, the submission of applications by associations wishing to be registered as political parties, the commission shall consider all the applications received and verify the claims of the association.

The commission in verifying the claims shall among other things:

Display the list of the names on the application and membership of the political association as contained in the documents submitted to the commission, in every District.

Check the names on the application to ensure that they are registered voters;
Check whether the membership contravenes any of the provisions of paragraph 6 of these guidelines;
Ascertain whether: the association has offices in various districts of the state and in the Capital city Territory as required by paragraph 4 of these guidelines;
the Constitution and manifesto of the association comply with the provisions of the Constitution, the Electoral Act and Political Parties Act 2007, 19(2),(4)) and these guidelines;
the composition of members of its executive committees and administr

Eligibility
You must be a citizen of Kenya of 18 years of age and above.
You must not be a traditional Ruler
You must not be a member of the public service of the federation or of a state as defined by the Constitution.
You must not be a member of the armed forces of the Republic or of Kenya Police Force or security and paramilitary organs of the government.
Membership shall be in personal capacity not by reason of being a member of youth club, wing, or vanguard or any association seeking registration

Instructions
1) Every political party shall--
(a) have a national character as prescribed by an Act of Parliament;
(b) have a democratically elected governing body;
(c) promote and uphold national unity;
(d) abide by the democratic principles of good governance,promote and practice democracy through regular, fair and free elections within the party;
(e) respect the right of all persons to participate in the political process, including minorities and marginalised groups;
(f) respect and promote human rights and fundamental freedoms, and gender equality and equity;
(g) promote the objects and principles of this Constitution and the rule of law; and
(h) subscribe to and observe the code of conduct for political parties.

(2) A political party shall not--
(a) be founded on a religious, linguistic, racial, ethnic, gender or regional basis or seek to engage in advocacy of hatred on any such basis;
(b) engage in or encourage violence by, or intimidation of, its members, supporters, opponents or any other person;
(c) establish or maintain a paramilitary force, militia or similar organisation;
(d) engage in bribery or other forms of corruption; or
(e) except as is provided under this Chapter or by an Act of Parliament, accept or use public resources to promote its interests or its candidates in elections.

The chairperson must submit the application in person.
The association must own offices in various districts of the state and in the Capital city as required by paragraph 4 of the electoral guidelines.
The Chair person should have not registered as a voter in the area where he/she intends to vote during the elections
A political party is expected to win at least one seat in the National Assembly or State Houses of Assembly or risk to be deregistration.


Required Information
(a)The names, signatures, residential addresses and
(b)information on states or local council areas of origin respectively of members
(c) information on the national and state executive committees and the records of proceedings of the meeting where these officers were elected.
(d) The name or acronym of the association must in line with the laws that are acceptable in Kenya .



Need for the Document
A political party for the purposes is defined as an organization of registered voters that has qualified to participate in an election by meeting all prescribed statutory requirements.

Kenya has a multi-party system with sometimes two or three stronger parties and a third party that is electorally successful.Political parties are registered with the Registrar of Societies under the amendment of the Political Parties Act 2007 and under the lenient regime of the Societies Act (Cap 108). This Act also supplies the administrative machinery necessary to monitor and enforce the political party compliance. The Political Parties Act of 2007 mandat that registration of political parties be undertaken by the Registrar of Political Parties whose office falls under the Interim Independent Electoral Commission (IIEC; Political Parties Act 2007, 3, 4).
