Procedure
The Asylum Visa is issued to a person who has left his/her country of origin and has entered Kenya seeking asylum i.e. the right to be recognized as a refugee and receive legal protection and material assistances

Apply In Person
An asylum seeker at the point of entry in Kenya is to declare to the immigration officers that he/she is seeking asylum in Kenya. Here he will received by an appointed officer who shall direct him to the nearest refugee reception centre.
At the refugee reception centre, the asylum seeker is to present himself before a registration officer and apply to be recognized as a refugee.
Here the asylum seeker will be given an application form “Refugee Status Determination Application Form - Form 1” to fill. If the asylum seeker cannot fill the form the registration officer shall fill in the asylum seeker’s information in the registration form.
Additionally, the registration officer shall take the fingerprints and photographs of the asylum seeker at the time of registration.
The asylum seeker should lodge the complete application in triplicate form in person at the designated refugee reception office within thirty days of his entry into Kenya.
He is to also produce any identification document that he has in his possession.
If the asylum seeker came to Kenya with his family. He/ She and members of his/ her family are to appear in person for a registration interview. An appointed officer shall refer the asylum seeker and members of his family already within Kenya to the nearest refugee registration officer for reception and registration interviews.
The appointed officer in charge of a registration centre shall carry out the interviews and fill the “Refugee Status Determination Application Form - Form 1” for all the family members
The registration officer will also take the fingerprints and photographs of the asylum seeker at the time of registration.
The family members are also to produce any identification documents they have in their possession.
The Commissioner shall ensure the fingerprints of an asylum seeker and family members taken are checked against all national fingerprint databases and will also forward the applications of all the asylum seekers registered in that centre to the refugees status determination centre.
An asylum seekers having applied for the refugee status will be issued with an asylum seeker pass which shall remain valid for one year from the date of issuance, or until a final determination of the asylum application, whichever is the earlier.
The Commissioner shall inform an asylum seeker on the refugee status determination centres where the asylum seeker shall present himself for determination of his asylum application.

Note:
The asylum seeker pass will be issued to the asylum seeker, specifying the time and date when the asylum seeker shall return to a specified refugee reception office and also notifies the asylum seeker that failure to comply with the condition of appearing personally at a designated refugee reception office no later than the time and date specified may result in withdrawal of the pass.
An asylum seeker is required at all times to be in possession of the asylum pass as proof of legal status in Kenya.
A pass shall be valid only if an official stamp of the Refugee Department has been affixed to it and is signed by the issuing officer and the asylum seeker.

Eligibility

A person who has left his/her country of origin and has entered Kenya seeking asylum i.e. the right to be recognized as a refugee and receive legal protection and material assistance.

Fees

It is issued free of charge / gratis.

Validity

The asylum seeker pass is valid for a period of one year from the date of issuance, or until a final determination of the asylum application, whichever is the earlier.
A pass shall be valid only if an official stamp of the Refugee Department has been affixed to it and is signed by the issuing officer and the asylum seeker.

Need for the Document

The asylum Visa certifies that the holder, is an asylum seeker whose claim for refugee status is being examined by the Commissioner for Refugees. As an asylum seeker, the holder is a person of concern to the Office of the Commissioner for Refugees, and should, in particular, be protected from forcible return to a country where he/she claims to face threats to his/her life or freedom, pending a final decision on(his/her refugee status

Information which might help

An asylum-seeker is a person who has left his/her country of origin and formally applied for asylum in another country but whose claim has not yet been concluded.
If an applicant is denied refugee status at the first instance level during refugee status determination (RSD), he/she can appeal this negative decision. Until a final decision is reached, this person remains an asylum-seeker.
An asylum seeker is someone who is seeking international protection but whose claim for refugee status has not yet been determined. In contrast, a refugee is someone who has been recognised under the 1951 Convention relating to the status of refugees to be a refugee.
An asylum seeker shall, at all times, be in possession of the asylum pass / visa as proof of legal status in Kenya.
An asylum seeker shall surrender any permit issued to him under the Immigration and Aliens Restriction Act for cancellation before being issued with an asylum pass.

Other uses of the Document/Certificate

The Asylum Visa can be used to make an application for a movement pass.
(i) A movement pass is a legal document issued by the Commissioner for refugee affairs to an asylum seeker or a refugee with a genuine reason to facilitate movement outside the designated area.
(ii) The main reasons for issuing a pass include resettlement, medical, education, or on humanitarian consideration.
(iii) The validity of the pass is stated and the beneficiary should return to the designated area before it expires or risk being prosecuted for residing outside the designated area without authorization
